HIT24 Facilities Liability Waiver & Release

PLEASE READ CAREFULLY – THIS IS A LEGAL DOCUMENT. BY SIGNING, YOU WAIVE CERTAIN LEGAL RIGHTS.

This Liability Waiver and Release (“Waiver”) is entered into by the undersigned participant (“Participant”) in favor of HIT24 (“Facility Provider”), its owners, officers, employees, agents, and representatives.

1. Acknowledgment of Risk

I understand that participation in activities at HIT24 Facilities, including but not limited to batting cages, pitching, throwing, use of machines, or other athletic activities, involves inherent risks of injury, illness, or property damage, including but not limited to sprains, fractures, concussions, and other serious injuries. I voluntarily assume all risks associated with participation.

2. Assumption of Responsibility

I agree that:

• I am participating voluntarily and at my own risk.
• I am physically capable of participating in activities at HIT24 Facilities.
• I will follow all posted rules, instructions, and safety procedures, including wearing required protective equipment such as helmets in cages.

3. Waiver and Release

I, for myself, my heirs, executors, administrators, and assigns, hereby release, waive, and forever discharge HIT24, its owners, officers, employees, agents, and representatives from any and all claims, demands, causes of action, or liability, whether known or unknown, arising out of or related to:

• Any injury, illness, or death occurring while using HIT24 Facilities;
• Any injury to siblings, parents, guardians, or other guests present in the facility;
• Loss or damage to personal property;
• Any negligent act or omission by HIT24, except in cases of gross negligence or intentional misconduct.

4. Indemnification

I agree to indemnify and hold harmless HIT24 from any claims, demands, or actions brought by third parties arising out of my actions or use of the facility, or the presence of my family or guests in the facility.

5. Emergency Medical Treatment

I authorize HIT24 staff to seek emergency medical treatment if necessary and agree that I am responsible for all medical costs incurred.

6. Acknowledgment of Understanding

I have read this Waiver carefully, understand its contents, and sign it voluntarily. I understand that I am giving up certain legal rights by signing this Waiver.

HIT24 Facilities Rules and Usage Agreement

This Facility Rules and Usage Agreement (“Agreement”) is entered into between HIT24 (“Facility Provider”) and the undersigned user (“User”) as of the date signed below. By signing this Agreement, the User agrees to comply with all facility rules and regulations as outlined herein.

1. Facility Access and Usage

1.1 Authorized Access / Members Only: Only registered and authorized members are permitted to access HIT24 Facilities. Guests must be accompanied by a member and approved by staff. Every athlete in the cages must be a member. If a member is caught bringing a non-member into the cages, their membership will be revoked immediately without warning. Users must present valid identification or membership credentials upon request.

1.1 Equipment: Balls, tees, and front toss nets are provided for each hitting cage with machines. Baseball cages have baseballs and softball cages have softballs. Pitching cages #5 & #6 are not equipped with balls for pitching (May bring your own). 

1.2 Cage Usage: Cages #1-4 are for hitting and or pitching. No hitting is prohibited in Cages #5 & #6 they are for pitching only.

1.3 Hours of Operation: Users may access facilities only during designated operational hours. HIT24 reserves the right to modify hours of operation with prior notice.

1.4 Doors: All doors must remain closed at all times unless authorized by facility staff.

1.5 Personal Belongings: Users are responsible for their personal belongings. HIT24 is not liable for any lost, stolen, or damaged items/ equipment.

2. User Conduct

2.1 Behavior: Users must conduct themselves in a professional and respectful manner. Abusive, disruptive, or unsafe behavior is strictly prohibited.

2.2 Prohibited Activities: Smoking, alcohol consumption, illegal substance use, gum, sunflower seeds, and tobacco are strictly prohibited within HIT24 Facilities.

2.3 Team Activities: Team practices are not permitted in the facility unless specifically authorized by HIT24 staff.

2.4 Equipment Use: Users must use all equipment and resources responsibly. Only approved balls may be used in machines—NO REAL BALLS USED IN MACHINES. Throwing is allowed only in designated cages, and helmets must be worn in cages at all times.

2.5 Cleanliness: Users must clean cages after use. Failure to do so may result in a cleaning fee charged to the user’s account.

2.6 Cage Bookings: Ensure members are only using cages personally booked in case of damage or injury.

3. Safety and Security

3.1 Compliance with Safety Rules: Users must follow all posted safety instructions and emergency procedures.

3.2 Emergency Situations: In the event of an emergency, users must comply with all instructions from facility staff and emergency personnel.

3.3 Health Guidelines: Users must adhere to all applicable health guidelines and protocols, including hygiene and sanitation rules.

3.4 Protective Equipment: Helmets are required in cages at all times when hitting or catching a pitcher.

4. Responsibilities

4.1 User Responsibility: Users are responsible for ensuring their actions do not endanger themselves or others.

4.2 Reporting Issues: Any safety hazards, equipment malfunctions, or incidents must be immediately reported to facility staff.

4.3 Financial Responsibility: Users may be held liable for damages to facility property caused by negligence or misconduct. Cleaning fees may be applied for failure to clean cages after use.

4.4 Auto renewed Monthly Payments: Payments are auto renewed by the system Monthly. 

4.5 Cancellation Policy: Memberships must be cancelled 5 days prior to renewal in writing by emailing Help@hit24.com with Facility name, member name and email. 

4.6 Payment Responsibilities: All fees and charges are due by their specified due dates. Failed Payment Fees will be applied to any charges that fail to process within the first 5 days of the due date.

4.7 No show Fee: Members are responsible for cancelling their cages if unable to attend their scheduled time. Failure to cancel in a promptly matter will result in a $10 no show fee. 

4.7 Equipment Theft: If a user is caught stealing equipment, legal charges will be pressed, and the user is responsible for the full cost of replacement.

5. Termination and Suspension

5.1 Suspension of Access: HIT24 reserves the right to suspend or revoke facility access for violations of this Agreement.

5.2 Immediate Termination: Severe breaches, including illegal activity, unsafe conduct, bringing non-members into cages, stealing equipment, or threats to safety, may result in immediate termination of facility access without prior warning.

6. Machine Usage

6.1 Switches: There are switches on the outside of the cages that will allow you too turn on and off the machines.

6.2 Speed/ Velocity: Machine pitching speed can be changed by adjusting the dial on the machine.

6.3 Pitch Selection: Pitches can be changed by adjusting the dial on the machine.

6.4: Height: Height of the pitch can be adjusted by a adjustable screw on the back of the machine which adjusts for different pitch heights. 

6.5 Swivel Adjustments: The machine can be swiveled to throw inside and outside pitching by slightly unscrewing a lever above the legs of the machine to where you would like the pitch and then tightening it back up! 

TIPS: Sometimes people turn the machines off at the machine instead of the switch, ensure the barrel feeder is on with a red light (switch is under barrel feeder), ensure machine is on with the dial, and the switch on the wall is turned on to push electricity to the machine!

7. DOOR ACCESS

7.1 Follow the instructions from Kisi sent to your email. (May go to spam).

7.2 Ensure Bluetooth and Location services are on and set as ALWAYS ALLOW

7.3 When you get to the door, click the lock button on the app and you will hear and click then pull the door open

8 Acknowledgment and Agreement

By signing below, the User acknowledges that they have read, understood, and agree to comply with the rules and regulations set forth in this Agreement. Failure to adhere to these rules may result in suspension or termination of facility access, as determined by HIT24 at its sole discretion.
